中国公布外国企业或个人在中国设立合伙企业管理办法

  
  2009年11月25日，国务院总理温家宝签署了《外国企业或者个人在中国境内设立合伙企业管理办法》（以下简称  
  《办法》），将于2010年3月1日起开始施行。  
 

《办法》明确了外国企业或者个人在中国境内设立合伙企业包括的具体情形，出资等事宜。《办法》指出，外国企

  
 

业或者个人在中国境内设立合伙企业申请设立登记的，应当向企业登记机关提交《中华人民共和国合伙企业登记管

  
 

理办法》规定的文件以及符合外商投资产业政策的说明。此外，《办法》强调，国家鼓励具有先进技术和管理经验

  
 

的外国企业或者个人在中国设立合伙企业。

  
     
  经营者集中审查办法发布  
  商务部近日发布了《经营者集中审查办法》（《审查办法》），自2010年1月1日起施行。《审查办法》明确商务  
  部是经营者集中反垄断审查执法机构，规定了审查听证会的具体程序。
  
  《审查办法》指出，在初步审查阶段，商务部应当在《反垄断法》第二十五条规定的期限内做出是否实施进一步审  
  查的决定。此外，《审查办法》指出，对集中交易方案进行调整的限制性条件包括三种类型。
